Court Orders Arrest of Habanos Lounge Director Over Noise Pollution Contempt

The Environment and Land Court has issued a warrant of arrest against Habanos Lounge director Maurice Asira after finding him in contempt of court for flouting noise pollution orders.

In a virtual ruling delivered on August 28, 2025, Justice Charles Mbogo directed that Asira, who manages Taks & M Habanos Chill & Grill Limited, appear in court on October 22 to explain why he should not be jailed or fined for disobeying judicial orders.

Residents’ Complaints

The case was filed by residents led by Mary Ann Wariithi, chairperson of the petitioner group, who accused the entertainment joint of persistently blasting music above permissible limits despite a restraining order issued on October 17, 2024.

Evidence presented in court, including expert noise-level tests and sworn affidavits, showed that the lounge continued to exceed the maximum allowable 35 decibels at night.

Residents accused the management of operating with impunity and disregarding both county enforcement and court authority.

Judge’s Warning

Justice Mbogo underscored the seriousness of the violation, warning that contempt of court would not be tolerated.

“The 1st respondent is in total disobedience of this court’s orders and undermines the authority of the court. Such conduct will be dealt with firmly to prevent future defiance,” he ruled.

Although the judge stopped short of imposing penalties immediately, he ordered that Asira be brought before the court to face possible jail time or fines.

The case highlights growing friction between entertainment establishments and Nairobi residents over noise pollution, an issue that has sparked multiple court battles and enforcement crackdowns in recent years.
