NAIROBI, Kenya- The Director of Public Prosecutions (DPP) has opposed a bail application by a 61-year-old man currently serving a 30-year jail term for his role in the Dusit D2 Hotel terror attack.
Mohamed Abdi Ali was convicted on 22nd May 2025 and sentenced on 19th June 2025 for conspiring with others to commit a terrorist act and facilitating the January 2025 attack that left 21 people dead.
Ali subsequently filed an appeal on 27th June 2025 and is now seeking bail pending the hearing and determination of that appeal.
The DPP, through Prosecuting Counsel Duncan Ondimu, argued that the offences committed are serious terrorism-related crimes, and that the gravity of the acts strongly weighs against granting bail.

Ondimu said public safety and confidence in the justice system would be better preserved by denying the request.
He further noted that the applicant had failed to demonstrate any irreparable prejudice that would occur if the appeal proceeds while he remains in lawful custody.
“The applicant has not demonstrated that the appeal has overwhelming chances of success but merely expresses dissatisfaction with the findings and conclusions of the trial court,” Ondimu said.
Ali sought bail on medical and family grounds under a certificate of urgency. The matter is scheduled for mention on 28th February 2026.
The DPP emphasized readiness to proceed with the appeal expeditiously, underscoring the importance of prioritizing justice for victims and their families.
