NAIROBI, Kenya – Former Kiambu Governor Ferdinand Waititu isn’t backing down after a 12-year prison sentence and a Sh52.5 million fine over a Sh588 million graft case.
Days after the ruling, Waititu has filed an appeal at the High Court, arguing that the verdict was unfair and should be overturned.
Through his lawyer Danstan Omari, the ex-governor now seeks bail pending the appeal, claiming that serving time before the court reviews his case would be unjust.

Waititu Wants Out—At Least for Now
Waititu’s legal team insists that denying him bail would undermine the appeal process, as he could serve part or all of his sentence before the final ruling.
“The applicant is apprehensive about the time it will take to hear and determine the appeal. If successful, the appeal will be rendered nugatory, and the applicant will have already served part or all of the sentence,” reads his court application.
Additionally, Waititu has asked the court to allow him to use the bond security he previously deposited in Nairobi Anti-Corruption Case No. 22 as a continuing bond for his release.
His legal team argues that his appeal raises critical legal questions, making him entitled to bail while awaiting judgment.
The ruling delivered at Milimani Law Courts last week didn’t just send Waititu behind bars—it also barred him from running for public office for seven years.
His wife, Susan Ndung’u, received a one-year sentence or a Sh500,000 fine, while their co-accused, Testimony Enterprises Limited director Charles Chege, was handed a nine-year jail term or a Sh295 million fine.
Another director, Beth Wangeci, was fined Sh1 million or sentenced to one year in prison.

While the court convicted them on graft charges, it acquitted the group on three counts of money laundering.
What’s Next for Waititu?
With the appeal now before the High Court, all eyes are on whether Waititu will be granted bail or remain behind bars while fighting his conviction.
His legal team maintains that he won’t interfere with the case and is fully prepared to comply with any conditions set by the court.
