High Court Denies Bail to Ex-Kiambu Governor Ferdinand Waititu Pending Appeal

NAIROBI, Kenya — Former Kiambu Governor Ferdinand Waititu will remain behind bars after the High Court denied his request for bail pending appeal.

The court ruled that Waititu failed to present compelling reasons for his release, despite his claims of health concerns.

Waititu argued that his health conditions required specialized care outside prison.

However, the court countered that correctional facilities are equipped with medical services, and in severe cases, inmates can be referred to a hospital.

This ruling aligns with past cases where courts have rejected medical grounds as a basis for bail unless clear proof of inadequate treatment is provided.

Bail Isn’t a Right, It’s Earned

In its decision, the court reiterated that the right to bail is not automatic.

An applicant must demonstrate that their appeal is arguable and has a reasonable chance of success. Waititu’s defense failed to meet this threshold.

Additionally, the court dismissed his claim that the appeal process would take too long, emphasizing that the matter will be expedited.

The judge assured that the appeal would be heard and determined within two months, given that the main appeal has already been filed.

Waititu’s legal troubles stem from a Sh.588 million graft case that saw him sentenced to 12 years in prison or a Sh52.5 million fine.

His appeal seeks to overturn this decision, but for now, he’ll remain in custody as the legal process unfolds.
