MOMBASA, Kenya – The Office of the Director of Public Prosecutions (ODPP) has successfully secured a 20-year prison sentence against a 21-year-old man convicted of repeatedly defiling a minor in Likoni Sub-County.
Al Haji Majaliwa was sentenced by Senior Resident Magistrate David Odhiambo at the Mombasa Law Court.
Principal Prosecution Counsel Barbara Sombo led the case, which the court found proven beyond reasonable doubt.
In his ruling, Magistrate Odhiambo stated that the prosecution clearly established three key elements: actual penetration, the victim’s age of 14 years, and the accused’s identity as the perpetrator.
“The accused failed to dislodge himself from the prosecution’s case, which remained on a high pedestal,” the magistrate noted, referring to Section 211 of the Criminal Procedure Code.
Majaliwa was charged under Section 8(1) as read with Section 8(3) of the Sexual Offences Act for defilement.
The offenses took place between January 1 and March 2, 2024, in the Mwananguvuze area of Likoni.
Court proceedings revealed that the 14-year-old girl had left her family home after a disagreement with her parents and began living with Majaliwa, whom she described as her boyfriend.

She stayed with him for several days, during which repeated sexual acts occurred despite his knowledge of her underage status.
The prosecution called four witnesses, whose accounts were supported by compelling medical evidence.
A clinical officer from Likoni Sub-County Hospital testified that an examination showed a broken hymen and injuries consistent with sexual penetration.
The minor was also treated for sexually transmitted infections and a urinary tract infection.
Key exhibits included medical treatment notes, a post-rape care form, and a P3 medical legal report.
An investigating officer further confirmed that Majaliwa and the girl had been cohabiting as if husband and wife before his arrest.
Authorities have urged parents, guardians, and community members to report suspected cases promptly and support victims in seeking medical and legal help.
