NAIROBI, Kenya – President William Ruto has affirmed that his administration will respect all court decisions, even when certain rulings conflict with government policy, emphasizing the need to uphold the rule of law.
Speaking on the relationship between the judiciary and government policy, Ruto acknowledged that he has on several occasions questioned court decisions that he believes could hinder the implementation of key public programmes.
“These concerns are neither expressed lightly nor out of disregard or contempt for the court. It is out of duty to speak honestly and candidly about the consequences such decisions have on the lives and livelihoods of the Kenyan people,” the President said.
Ruto stressed that his government has consistently pursued lawful avenues, including appeals where available, rather than ignoring or defying judicial orders.
“Where we have been dissatisfied, we have chosen the lawful path of appeal where available rather than defiance or disregard of court orders,” he added.
He gave a firm assurance that the government will always abide by court rulings, stating: “At all times and in all circumstances, we remain guided by one immutable principle: the rule of law must prevail, because without it, no policy, programme, government or country can endure.”
The President also congratulated the newly appointed judges of the Court of Appeal, highlighting their critical role in strengthening Kenya’s judiciary.
Beyond affirming respect for the courts, Ruto announced plans to seek judicial guidance on the status of policy documents, including election manifestos, when their implementation is legally challenged.
“The ultimate authority in the Republic of Kenya is the people, and they speak to us through their votes. I want to understand when the people vote for a manifesto and it is endorsed as a policy document, where does it stand when its implementation is challenged?” he said.
By raising the issue, Ruto emphasized the need to balance judicial oversight with the electorate’s mandate, particularly when court decisions delay or block the rollout of popular government policies.
His administration has faced legal hurdles in implementing certain programmes due to public participation requirements.
Ruto’s commitment to consulting the judiciary underscores an effort to align governance with constitutional obligations while ensuring effective delivery on manifesto promises.
