CJ Koome Faces Potential Removal as JSC Reviews Petitions

The drama unfolded after lawyer Nelson Havi submitted a petition accusing Chief Justice Martha Koome and six Supreme Court justices of misconduct, graft, and misbehavior.

On January 16, JSC Vice Chairperson Isaac Ruto confirmed receipt of the petition during a press briefing. 

“The complaints filed will be dealt with by the processes and procedures developed and in compliance with the rule of law and the Fair Administrative Action Act,” Isaac Ruto stated. 

He further emphasized the JSC’s commitment to balancing judicial accountability with independence.

Havi’s petition, filed on January 10, 2025, targets Chief Justice Koome, Deputy Chief Justice Philomena Mwilu, and Supreme Court Judges Mohammed Ibrahim, Smokin Wanjala, Njoki Ndungu, Isaac Lenaola, and William Ouko. 

According to Havi, their actions undermine public trust in the judiciary.

The JSC has received five petitions against judges since the start of 2025, including two separate allegations against High Court Justice Alfred Mabeya. 

These complaints were submitted by Havi and Cytonn CEO Edwin Dande, citing gross misconduct and misbehavior.

With CJ Koome named in the petition, she is barred from participating in JSC deliberations on the matter. Vice Chairperson Isaac Ruto will lead the proceedings, with the commission expected to deliver its recommendations to President William Ruto.

Chief Justice Koome has not taken these allegations lightly. Speaking to reporters, she firmly dismissed calls for her resignation.

“I was appointed to serve for a tenure, and you have not given me reasons why you would want me to resign,” she stated. Koome vowed to complete her term, reiterating her resolve against intimidation.
