Court Declares University Lecturers’ Strike Unprotected, Urges Dialogue

NAIROBI, Kenya — The Employment and Labour Relations Court has declared the ongoing strike by university lecturers under the University Academic Staff Union (UASU) unprotected, instructing the union’s leaders to re-engage in negotiations with the government.

The court emphasized the need for dialogue to develop a Return-to-Work formula to address the union’s grievances, which center around the 2022-2025 Collective Bargaining Agreement (CBA).

University lecturers launched the strike on Tuesday, halting academic activities in public universities nationwide. The union is demanding the government honor commitments outlined in the CBA, including salary adjustments and improved welfare benefits.

UASU Secretary General Constantine Wasonga reiterated that the union is committed to protecting lecturers’ rights and called on the government to fulfill its obligations.

“Our members have downed tools for fair treatment and a negotiated agreement to cater to their welfare,” he said.

The court has granted UASU and other involved parties a 14-day window to file their responses, with the case set for mention on November 28, 2024.

Meanwhile, the court’s directive seeks to end the impasse that has left students and parents in limbo, with learning paralyzed for over 24 hours.
