NAIROBI, Kenya – Chief Justice Martha Koome has called on actors in Kenya’s justice sector to build a compassionate and inclusive system that meets the complex needs of families.
Speaking during the Milimani Chief Magistrate Family Court Open Day, themed “Bridging the Gap: Enhancing Access to Justice through Collaboration,” CJ Koome emphasized that family disputes are not just legal issues, but deeply emotional and social matters that require a humane approach.
She said family justice must be collaborative and responsive to lived experiences — involving not only judicial officers but also children’s officers, probation staff, advocates, psychologists, mediators, faith leaders, and civil society groups.
“Family disputes deeply affect the family unit, the foundation of society,” said Koome, underscoring the need for specialized courts and services.
She pointed to the establishment of dedicated family courts — including the Milimani Chief Magistrate’s Family Court launched in 2023 — as a major step in justice reform.
The court, she noted, has significantly reduced delays and improved access to justice for vulnerable groups like children, women, and the elderly.
In its first year, the Milimani court recorded 2,383 new filings and concluded 2,355 cases.
That number rose in 2024 to 2,960 filings and 3,308 cases concluded. In 2025, the court has already handled 909 new filings and concluded 965 cases.
The Chief Justice also highlighted the role of Court Users Committees (CUCs) in fostering dialogue and coordination, and urged greater use of mediation and Alternative Justice Systems (AJS) to resolve disputes.
Justice Everlyne Olwande, head of the family court and a member of the Judicial Service Commission, said the court’s approach embraces ADR and integrates local customs to deliver culturally sensitive justice.
“Our goal is not just to apply the law, but to respect the values and traditions that shape how communities resolve conflicts,” she said.
The open day served as an opportunity for the public to learn about the court’s services, offer feedback, and strengthen trust in the justice system.
