DPP Opposes Bail for Police Officer Charged with Killing Nairobi Street Vendor

NAIROBI, Kenya – The Director of Public Prosecutions (DPP) has opposed the release on bond of a police constable charged with the murder of street vendor Bonface Kariuki Mwangi, urging the court to keep him in custody until the case is heard and determined.

Appearing before High Court Judge Kanyi Kimondo on Monday, the prosecution argued that the accused, Constable Klinzy Barasa Masinde, poses a serious risk to witnesses, the public, and the integrity of the trial if released.

Masinde, 32, has pleaded not guilty to a single count of murder in connection with the fatal shooting of Kariuki on June 17, 2025, outside Imenti House in Nairobi.

The DPP told the court that Masinde, as a serving police officer, has both technical capacity and institutional access that could be used to intimidate or influence potential witnesses—including fellow officers who allegedly witnessed the shooting.

“He has access to sensitive law enforcement tools and data that may aid in tracking or interfering with witnesses,” the prosecution submitted, warning that such interference could derail the case.

The court also heard that Masinde’s release could trigger public unrest, citing widespread anger following Kariuki’s killing, which sparked demonstrations and renewed calls for police accountability.

“There is legitimate concern for the accused’s own safety and for public order, given the heightened emotions surrounding this case,” prosecutors added.

The DPP further argued that releasing Masinde on bond could erode public trust in the justice system, especially amid ongoing scrutiny over police use of force.

Justice Kimondo confirmed that Masinde had undergone a mental assessment and was declared fit to stand trial.

The court directed the defence to file a formal bond application within seven days, with the DPP given an equal period to respond.

The bond hearing has been scheduled for August 19, 2025. Meanwhile, Masinde remains in custody as the court prepares to begin the trial.
