Through his legal team at Swanya and Company Advocates, Gachagua argues that the impeachment motion is built on “falsehoods and misrepresentation of material facts,” aimed at achieving an unconstitutional outcome.
In the petition, Gachagua refers to the impeachment as a “choreographed political lynching” intended to undermine the will of the Kenyan electorate, who voted in the 2022 presidential election.
He takes issue with the brief period allocated for public participation in the impeachment process, terming the one-day window provided by the National Assembly as “grossly insufficient” for meaningful input from the public.
The Deputy President further argues that public participation must be conducted across all 290 constituencies, the diaspora constituency, and the 1,450 electoral wards, to truly reflect the democratic process.
He also disputes the allegations of corruptly acquiring assets worth KSh 5.7 billion, calling them baseless and politically motivated.
Gachagua has asked the court to intervene and stop the National Assembly from processing or passing any resolution on the impeachment notice dated September 26.
His legal team contends that the assembly should be prohibited from transmitting any such resolution to the Senate.
This petition is part of Gachagua’s broader effort to block the impeachment, which he says is being pursued with undue haste and without adequate public scrutiny.
