KIAMBU, Kenya — The Director of Public Prosecutions (DPP) has opposed a bail application filed by a man serving a 30-year prison sentence for his role in the Dusit D2 terror attack.
The application was filed at the Kiambu High Court by Mohamed Abdi Ali, 61, who is seeking release on bail pending the hearing and determination of his appeal.
Mohamed was convicted on May 22, 2025, and sentenced on June 19, 2025, to serve an aggregate sentence of 30 years’ imprisonment. The court found him guilty of conspiring with others to commit a terrorist act and facilitating the January 2025 attack at the Dusit D2 hotel complex.
The attack left at least 21 people dead and injured several others.
In opposing the application, the DPP, through Prosecuting Counsel Duncan Ondimu, told the court that the offences were grave, terrorism-related, and posed serious public safety concerns.
He argued that the severity of the crimes and the need to maintain public confidence in the justice system weighed heavily against granting bail pending appeal.
“The interests of justice would be best served by expediting the hearing and determination of the appeal rather than granting bail on insufficient grounds,” Ondimu submitted.
The prosecution further told the court that Mohamed had failed to demonstrate that he would suffer irreparable prejudice if the appeal proceeds while he remains in lawful custody.
Ondimu added that the applicant had not shown that his appeal had overwhelming chances of success.
“The applicant merely expresses dissatisfaction with the findings and conclusions of the trial court,” he said.

According to court filings, Mohamed lodged his appeal on June 27, 2025, and filed the bail application under a certificate of urgency. He cited medical and family grounds in support of his request for temporary release.
The DPP said the prosecution was ready to proceed with the appeal without delay.
The matter is scheduled for mention on February 28, 2026.
