High Court Halts PSC Deputy Secretary Appointments Pending Case

NAIROBI, Kenya – The High Court has temporarily halted the Public Service Commission (PSC) from conducting interviews and appointments for several Deputy Commission Secretary positions, following a legal challenge filed by Victor Okoth.

Justice Bahati Mwamuye issued the interim order, citing a need to pause the recruitment process until the court fully reviews the case.

The directive restrains the PSC from filling roles under the titles of Deputy Commission Secretary for Organization Design and Career Management Services, Recruitment and Selection, Human Resource Management and Development Services, and any other deputy secretary positions within the commission.

“Pending the inter partes hearing and determination of the application dated November 11, 2024, a conservatory order is issued, preventing the respondent from conducting interviews or appointments for these deputy secretary roles,” reads part of the order issued by Justice Mwamuye.

This injunction will remain effective until the court addresses Okoth’s application in full.

Meanwhile, Justice Mwamuye has instructed Okoth to serve copies of the application and order to the PSC by November 13.

The PSC has been given a deadline of November 29 to file their response.

The court will hold a mention for further directions on the case on December 18.

This decision effectively stalls PSC’s ongoing recruitment process and signals that the commission’s hiring policies are under scrutiny, pending judicial review.
