NAIROBI, Kenya – In a ruling on April 14, 2025, the Transport Licensing Appeals Board (TLAB) issued a series of orders compelling Supermetro SACCO Limited to address several compliance issues related to vehicle safety and driver behavior.
The board’s decision came after hearing arguments from both parties involved in the case.
The orders specifically target violations concerning speed limiters, vehicle inspections, overspeeding by drivers, and road safety sensitization for the SACCO’s staff.
The key directives from the TLAB include:
- Immediate Compliance Check for Speed Violations: Supermetro SACCO is required to deliver eight identified vehicles with speed limiter violations to the Likoni Motor Vehicle Inspection Center for an immediate compliance check.
- Inspection of 31 Vehicles: The SACCO must also present 31 vehicles with various compliance inspection issues to the Likoni Motor Vehicle Inspection Center. Compliance reports must then be submitted to the National Transport and Safety Authority (NTSA) Directorate of Safety.
- Retesting of Drivers with Overspeeding Violations: 42 drivers from Supermetro SACCO who have been flagged for overspeeding violations are required to retake their driving tests at the Likoni Driver Test Centre.
- Disengagement of Non-Compliant Drivers: The SACCO is mandated to immediately disengage 269 drivers, as per a list marked “SPM7” in the Respondent’s affidavit.
- Provision of Road Safety Sensitization Records: Supermetro SACCO must provide minutes and attendance lists for road safety sensitization sessions conducted for all its drivers to the Director of Road Safety at NTSA.
- Suspension of Operations: Until the SACCO fully complies with the above orders, the previous suspension order issued by NTSA on March 18, 2025, is reinstated. Supermetro SACCO’s operations will remain suspended until the board confirms compliance with the directives.
- Police Involvement: The order has been served upon the Inspector General of the National Police Service to ensure enforcement.
The board has scheduled a mention of the matter for April 17, 2025, to confirm compliance and determine further directions or actions.
This ruling highlights the ongoing efforts by the NTSA and the Transport Licensing Appeals Board to enforce strict adherence to safety and operational regulations in Kenya’s public transport sector, aiming to reduce road accidents and enhance safety standards across the country.
