Azziad Moves to Court to Block Sale of Her Kileleshwa Home

NAIROBI, Kenya – Content creator and media personality Azziad Nasenya has moved to the Commercial Court in Nairobi seeking to stop the planned auction of her Kileleshwa apartment, which she says was acquired through a mortgage.

According to court papers, the TikTok star claims she faces the risk of losing her home despite clearing all outstanding arrears owed to a deposit-taking savings and credit cooperative (Sacco) that financed the purchase.

Azziad says she legally obtained a Sh20.3 million loan from the Sacco in April 2024 to acquire the apartment, and that the institution prepared a charge over the property two months later to secure the facility.

“The court will note that recital ‘B’ of the charge expressly states that the chargee would not call for, sue for, or require repayment of the loan outside the period specified by the charge,” she states in her plaint.

Court filings show that she began repaying the loan and had paid Sh897,924.68 before falling behind on instalments due to what she termed as “current economic hardships,” with arrears of Sh1.5 million as of September 2025.

She alleges that the Sacco deducted Sh2.45 million from her member savings on September 19, 2025, effectively clearing the arrears in full.

However, five days later, on September 24, an auctioneer published a notice announcing that the apartment would be sold by public auction on October 8, 2025, citing an outstanding sum of Sh21.8 million.

Azziad argues that the auction move was unlawful and premature, saying the Sacco breached the loan agreement and failed to issue statutory notices as required under the Land Act.

She also accuses the financial institution of undervaluing her property by describing it as a three-bedroom instead of a four-bedroom apartment — a classification she says could lead to its sale below market value.

“The plaintiff is not in loan arrears, and the purported notice by the defendants to auction the property is illegal, unlawful, and therefore null and void,” she says in her filing.

Azziad now seeks a permanent injunction stopping the Sacco and the auctioneer from selling or interfering with the apartment, damages for breach of contract, and costs of the suit.

She maintains that she continues to live in the house and intends to keep servicing the loan as agreed.
