Cabinet Approves Judges’ Retirement Benefits Bill to Enhance Judicial Independence and Security

NAIROBI, Kenya — The Cabinet has approved the Judges Retirement Benefits Bill, 2025, which aims to significantly improve the retirement packages for judges of the superior courts.

The new law, which separates judicial retirement benefits from the general public pension system, underscores Kenya’s commitment to strengthening good governance, promoting judicial independence, and ensuring financial security for judges after their service.

The Judges Retirement Benefits Bill introduces a specialized retirement framework that recognizes the unique demands of judicial service.

Serving judges will be placed under a Defined Benefit system, guaranteeing fixed monthly pensions upon retirement, while new appointees will fall under a Defined Contribution system, where their benefits are determined by their contributions over time.

This reform marks a critical step toward providing judges with long-term financial stability, enhancing career satisfaction, and attracting highly qualified legal professionals into the judiciary.

Under the new framework, retired judges and their spouses will receive monthly pensions, gratuities, medical cover, and diplomatic privileges, ensuring they retire with dignity after years of serving the public under stringent ethical standards.

In a Cabinet statement, the government emphasized that the Bill is not only a retirement policy but an integral part of reinforcing judicial independence, ensuring that judges are free from financial pressures that might otherwise influence their decisions.
