NAIROBI, Kenya — The Office of the Director of Public Prosecutions (Kenya) has opposed the release on bail of a Kenyan man wanted in the United States to face multiple cybercrime-related charges.
The prosecution told the court that 74-year-old Godfrey Mbogori is the subject of an international arrest warrant issued by the United States District Court for the Eastern District of Virginia, Richmond Division.
According to prosecutors, the U.S. court endorsed the warrant on November 15, 2023, seeking Mbogori’s arrest to face charges including conspiracy to commit computer intrusions, conspiracy to commit wire fraud, and aggravated identity theft.
Arrest in Meru after INTERPOL alert
Mbogori was arrested on February 19, 2026, in Meru by officers attached to the Anti-Terrorism Police Unit and the Joint Anti-Terrorism Task Force.
Authorities said the arrest was carried out pursuant to an INTERPOL Red Notice, which alerts law enforcement agencies worldwide that a suspect is wanted for arrest and extradition.
The ODPP told the court that a formal extradition request from the United States was received on February 26, 2026.
DPP cites risk of absconding
Prosecutors have urged the court to deny bail while extradition proceedings are ongoing, citing the seriousness of the offences and the potential risk that the suspect could flee.
The prosecution team argued that releasing Mbogori could undermine the integrity of the extradition process and Kenya’s obligations under international law.
“Kenya has international obligations to cooperate in the suppression of transnational crime,” the prosecution said, adding that granting bail to a suspect wanted under an international warrant could compromise extradition proceedings.

The case is being handled by a team led by Senior Deputy Director of Public Prosecutions Vincent Monda, alongside Assistant Director of Public Prosecution Duncan Ondimu and Principal Prosecution Counsel Victor Owiti.
Other members of the prosecution team include Magdalene Nduati and Fatma Shaban.
The court is expected to determine whether Mbogori will remain in custody as extradition proceedings continue to decide whether he will be handed over to U.S. authorities to face trial.
