NAIROBI, Kenya – The Independent Electoral and Boundaries Commission (IEBC) has denounced incidents of violence and disruption reported during Thursday’s by-elections, warning that political actors found to have incited or participated in chaos will face legal consequences.
In a statement, IEBC Chairperson Erastus Edung Ethekon said the Commission was “gravely concerned” by pockets of violence, intimidation and obstruction witnessed in parts of the country as voters cast their ballots.
He said the actions — some linked to known political figures and their supporters — violated core constitutional principles on the conduct of free and fair elections.
“These acts undermine Article 81 and Article 86 of the Constitution, which demand elections free from violence, intimidation and improper influence, and carried out in a simple, verifiable, secure and transparent manner,” the Commission said.
The IEBC added that the behaviour also contravenes the Elections Act, the Election Offences Act and election regulations that prohibit obstructing election officials, interfering with voting and counting, and disrupting the electoral process.
Strict Access Rules for Polling and Tallying Areas
As the counting of votes entered final stages, the Commission clarified that access to polling stations and tallying centres would be strictly limited under election law.
Only the following groups are permitted:
- IEBC officials
- Accredited party and candidate agents
- Accredited observers
- Assigned security officers
- Accredited media
“Tallying centres are protected areas and no unauthorised persons will be admitted,” the statement read.
Security Agencies Directed to Act
IEBC urged security officers deployed for the by-elections to stay vigilant and respond firmly to any disruptions during counting, tallying and declaration of results.
It also called on the National Police Service and Directorate of Criminal Investigations (DCI) to investigate all incidents of violence and ensure those responsible are held accountable.
The IEBC Elections Code of Conduct Committee will separately handle any complaints about breaches of the electoral code.
Voters Praised for Peaceful Participation
Despite the isolated incidents, the Commission commended the majority of Kenyan voters for maintaining peace throughout the day and exercising patience as the electoral process concluded.
“The few incidents of violence should not overshadow the commendable commitment demonstrated by the majority of voters in exercising their democratic right,” Ethekon said.
IEBC said it remains committed to completing the final stages of the election in full compliance with the Constitution, and will release results once verification is complete.
