Kisumu Stepfather Jailed for Life in Infant Defilement Case

NAIROBI, Kenya- A 37-year-old man has been sentenced to life imprisonment after the Kombewa Magistrate’s Court convicted him of defiling his nine-month-old stepchild.

The offence took place on July 19, 2025, at about 8.30 pm in Seme Sub-County, Kisumu County, the prosecution told the court. 

The man denied the charge and an alternative count of committing an indecent act with a child.

Principal Prosecution Counsel Caroline Kiptum led the prosecution, which called four witnesses. 

Their evidence included testimony from a clinician who examined the infant and found a fracture to the thigh bone and other injuries.

The court heard that the child’s mother had stepped out to seek medication from her mother-in-law after experiencing pain in her left hand. 

In her ruling, Principal Magistrate Jocelyn Kimetto said the prosecution had proved the defilement charge beyond reasonable doubt.

“I make a finding that the prosecution has discharged their burden of proof against the accused on the main charge and meets the required standard of beyond reasonable doubt,” Kimetto said.

The man was convicted under Section 8(1), read with Section 8(2), of the Sexual Offences Act. He has 14 days to appeal the conviction and sentence.
