Prosecutor Seeks Six Years in Jail on Each Count for Ex-Kiambu Governor Waititu and Wife

Date:

NAIROBI, Kenya- State prosecutor Vincent Monda has urged the court to sentence former Kiambu Governor Ferdinand Waititu and his wife, Susan Wangari, to six years in prison on each count in their Sh588.7 million graft case.

The prosecution’s request comes as the couple face sentencing proceedings following a High Court decision that overturned their earlier acquittals on money-laundering charges and upheld convictions arising from the controversial Kiambu roads tender.

Waititu and Wangari are among the accused in the case involving a Sh588.7 million contract awarded to Testimony Enterprises Limited for road upgrades in Kiambu County during the 2017/2018 financial year.

High Court Reversed Money-Laundering Acquittals

On October 14, 2026, High Court Judge Rose Ougo overturned the trial court’s acquittals on money-laundering charges while upholding convictions on other corruption-related offences.

The ruling returned the matter to the magistrate’s court for mitigation and sentencing proceedings. The High Court also revoked the accused persons’ bail and bond terms, resulting in their return to custody.

The prosecution has maintained that the High Court’s decision cleared the way for the accused to be presented for mitigation and sentencing.

However, the proceedings have faced a procedural dispute over whether the accused should be sentenced as individuals or in their corporate capacity.

During an earlier appearance before Anti-Corruption Chief Magistrate Harrison Barasa, Monda argued that the High Court had allowed the prosecution’s application in full and that the lower court should proceed in accordance with its directions.

The defence challenged that interpretation, arguing that clarification was needed because the accused had previously been acquitted on the money-laundering counts.

Case Stems From Kiambu Roads Tender

The case concerns a road-upgrading contract awarded to Testimony Enterprises Limited during Waititu’s tenure as governor.

The prosecution has linked the accused to alleged irregularities surrounding the procurement and handling of funds connected to the contract.

Waititu was initially sentenced to 12 years in prison, with an option of paying a fine, after his conviction in February 2025. The subsequent High Court proceedings upheld his convictions on several corruption-related charges and overturned the acquittals on money laundering.

The six-year term sought by Monda on each count represents the prosecution’s request and should not be confused with a sentence already imposed by the court.

The court’s final decision will determine the applicable penalties after the relevant sentencing proceedings.
