Chief Justice Koome Calls for Strong Institutions as Supreme Court Celebrates 12 Years

NAIROBI, Kenya- At a milestone event for Kenya’s Supreme Court, Chief Justice Martha Koome emphasized the critical role of robust institutions in advancing national development and upholding democratic values. 

Speaking at the opening of the Supreme Court’s inaugural conference and exhibition, she highlighted the court’s journey and impact over the past 12 years, noting its role as a pillar of stability and protector of the Constitution.

Since its inception, the Supreme Court has transformed Kenya’s legal and socio-political landscape. 

Through landmark decisions, the Court has shaped the nation’s jurisprudence, setting pivotal benchmarks that have influenced elections, devolution, and constitutional reforms. 

In her address, Chief Justice Koome celebrated the Court’s role in resolving presidential election petitions over the last three election cycles, ensuring transparency and reinforcing Kenya’s commitment to free and fair elections. 

This commitment to upholding democratic values underscores the Court’s mandate as the ultimate guardian of the Constitution.

“Institutions matter. They are the anchors of our democratic aspirations,” she remarked, underscoring the importance of the Supreme Court as an institution that fosters stability and predictability, especially in times of societal conflict.

Over the years, the Supreme Court has also rendered critical judgments on devolution and public participation. 

Notable cases, such as the Building Bridges Initiative (BBI) decision, clarified the legal boundaries for constitutional amendments, while the Finance Act, 2023 ruling established standards for public involvement in legislative processes. 

These rulings have fortified the Court’s commitment to democracy by ensuring that citizens’ voices are heard in matters of governance and lawmaking. 

Chief Justice Koome highlighted the Court’s advisory opinions on the relationship between Kenya’s National Assembly and Senate as crucial in solidifying devolution, a core tenet of the Constitution. 

Through these opinions, the Court has helped streamline interactions between the bicameral houses of Parliament, reinforcing devolution as a driver of Kenya’s development.

The Supreme Court’s commitment to justice extends into the realm of land rights and socio-economic issues. 

Chief Justice Koome pointed to landmark decisions addressing land grabbing, housing rights, and family law as proof of the Court’s dedication to protecting the rights of Kenyans. 

Reflecting on these achievements, Chief Justice Koome assured Kenyans that the Supreme Court remains steadfast in its role as a “beacon of justice” and “defender of the rule of law.” 

She expressed optimism for the future, calling for renewed unity and commitment to justice within the institution.

As the Supreme Court celebrates this 12-year milestone, Chief Justice Koome’s call for strong, resilient institutions resonates as a powerful reminder of the Court’s purpose. 

By anchoring Kenya’s democratic aspirations and championing the rule of law, the Supreme Court stands poised to navigate the challenges of a rapidly changing world, ensuring justice remains at the heart of Kenya’s national journey.
