NAIROBI, Kenya- Prominent lawyer Donald Kipkorir has called on Kenya’s key oversight and law enforcement agencies to apply election laws fairly and impartially as political activity intensifies ahead of the next General Election.
In a statement shared on social media, Kipkorir urged the Directorate of Criminal Investigations (DCI), the Ethics and Anti-Corruption Commission (EACC), the Independent Electoral and Boundaries Commission (IEBC) and the National Cohesion and Integration Commission (NCIC) to enforce the law equally, particularly on matters relating to political rallies, campaign speeches and voter bribery.
This was after the arrest of Mukurwe-Ini MP John Kaguchia over alleged hate speech.
According to the senior advocate, selective enforcement of the law risks undermining public confidence in democratic institutions and could fuel national divisions.
“DCI, EACC, IEBC & NCIC should apply the law in respect of current General Elections political rallies, political speeches & voter-bribery across the board equally & without bias,” Kipkorir said.
He warned that applying the law selectively creates conditions that can lead to national strife, arguing that justice must be administered without regard to political affiliation or status.
“To be selective in application of the law always lays the ground for national strife,” he stated.
Kipkorir also drew comparisons with countries he said have built strong democratic and governance systems through consistent enforcement of the rule of law.
“Countries become Singapore & South Korea because the law is truly blind,” he said.
The lawyer concluded his message with a call for justice, quoting the biblical passage from the Book of Amos:
“Let justice roll on like a river. Let righteousness flow like an ever-flowing stream.”
Opposition leaders led by DCP boss Rigathi Gachagua and Wiper Leader Kalonzo Musyoka have condemned the arrest, which they termed as selective.
Security agencies have been accused of using law enforcing agencies to manage politics.
