NAIROBI, Kenya – The Director of Public Prosecutions (DPP) has approved murder charges against Kimutai Maritim, making him the fifth suspect to face prosecution over the killing of Dr Victoria Mutiso.
Maritim will be charged alongside Rose Mbithe, her daughter Angela Mulwa, her son Chris Mulwa and Police Constable Elijah Kibelion Kimoi.
The five suspects are scheduled to appear before the High Court on September 29, 2026, for plea-taking following a directive by Justice Alexander Muteti.
Maritim Arrested in August
Maritim was arrested on August 22, 2026, after he allegedly attempted to visit suspects detained at Pangani Police Station.
Investigators reportedly intercepted him while he was allegedly trying to deliver a loaf of bread and a packet of milk to the detainees.
During earlier court proceedings, investigators told the court that Maritim was allegedly linked to the planning of the offence.
They also said he could assist in tracing other suspects who remain at large.
Five Suspects to Take Plea
Justice Muteti directed that all suspects connected to the case be physically presented in court for plea-taking.
The directive followed an earlier virtual proceeding involving Rose and Angela, who declined to participate remotely from Lang’ata Prison.
A prison officer told the court:
“My lord, the two have refused to appear before court virtually.”
The court subsequently directed that the suspects be presented physically.
Psychiatric Assessment Delayed Plea
The plea-taking for Rose and Angela had earlier been postponed after Justice Kanyi Kimondo ordered that the two undergo psychiatric assessments.
The assessments were intended to establish whether they were fit to plead to the murder charges.
Their physical appearance before the High Court on September 29 is expected to allow the court to address the plea-taking process alongside the other suspects.
Three Suspects Returned From Uganda
The prosecution has also indicated that three additional suspects arrested in Uganda in connection with the murder will return to court on October 1, 2026.
They are Police Constable Collins Bett Kilangat, Pius Muiruri Mbugua and Samuel Karanja Gathoni.
The three were arrested on August 29 at Kyanja Heights Flats in Nakawa, Kampala, before being returned to Kenya.
They have been detained for 30 days to allow investigators to complete their inquiries.
Prosecution Continues Investigations
The prosecution team is being led by counsels Jalson Makori and Pauline Muthuri.
The approval of charges against Maritim brings the number of suspects scheduled to face murder proceedings to five, while the separate case involving the three suspects returned from Uganda remains before the court.
The prosecution is expected to present its case as investigations continue into the circumstances surrounding Dr Victoria Mutiso’s death and the alleged roles of the suspects.
