MOMBASA, Kenya- The Ethics and Anti-Corruption Commission (EACC) has recovered a 0.514-acre parcel of Kenya Civil Aviation Authority (KCAA) land in Nyali, Mombasa, valued at Sh51 million.
The recovery followed an Alternative Dispute Resolution settlement on September 21, 2026, under which the registered owner, Omar Tahir, agreed to surrender the property to the public.
The land, registered as MN/I/2411, had been the subject of a civil case filed by the commission in 2009.
The dispute was between the EACC and Tahir, former Kuresoi MP Zakayo Kipkemboi Cheruiyot and former Commissioner of Lands Sammy Mwaita.
Court records show that the case over the property was still pending in 2013.
EACC’s account of the allocation
The commission said its investigations found that the land was set aside for KCAA but was irregularly allocated in 2000 by Mwaita to Cheruiyot. The former MP later transferred it to Tahir, according to the EACC.
The commission said the settlement brought an end to 17 years of court proceedings and returned the property to the public for its intended use.
“Reason has finally prevailed,” the EACC said, acknowledging the agreement that led to the land’s surrender.
The commission encouraged people holding public property it considers illegally or irregularly acquired to surrender it voluntarily.
It said doing so could restore public assets while avoiding lengthy court cases and associated costs.
