NAIROBI, Kenya- Michael Moragia Nyachae, a son of former Cabinet minister Simeon Nyachae, has been charged with stealing more than Sh1.2 million from a company associated with his family.
Moragia, 62, appeared before the Milimani Law Courts on Friday and denied stealing Sh1,226,036 from Sansora Group Limited.
According to the charge sheet, the money was allegedly stolen on various dates between March 28, 2019, and September 28, 2021, in Kisii County.
He was charged with stealing contrary to Section 268(1), as read together with Section 275, of the Penal Code.
Moragia was arrested on Thursday at Chepilat in Bomet County before being detained at Kileleshwa Police Station. He was subsequently presented before Milimani Principal Magistrate Caroline Nyaguthii.
His arrest followed a decision by Director of Public Prosecutions Renson Ingonga to approve the theft charge after reviewing evidence gathered by investigators.
The Office of the Director of Public Prosecutions said there was sufficient evidence to support the charge following a complaint lodged by Sansora Group Limited.
The case followed a three-year investigation by the Directorate of Criminal Investigations.
The DCI had recommended additional charges, including money laundering and forgery. However, the DPP directed investigators to conduct further inquiries into those offences after identifying gaps in the evidence presented.
“I have noted that there are gaps that need to be addressed as appertains to the charges that were to be instituted against the suspect under the Proceeds of Crime and Anti-Money Laundering Act No. 9 of 2009 and forgery,” the DPP said in a response to the DCI.
The prosecution did not oppose Moragia’s release on bail.
Magistrate Nyaguthii released him on a Sh200,000 bond or an alternative cash bail of Sh50,000.
The case will be mentioned on September 29, 2026, for further directions.
Moragia is a brother of former East African Court of Justice judge Charles Nyachae.
Their father, Simeon Nyachae, was a prominent politician and career civil servant who served in several senior government positions, including as Cabinet minister.
The charges against Moragia remain allegations, and he is presumed innocent unless proven guilty by a court.
