NAIROBI, Kenya — The Milimani Principal Magistrate’s Court has allowed the National Police Service (NPS) and the Independent Policing Oversight Authority (IPOA) to call additional witnesses in the inquest into the death of Rex Masai, saying the evidence is necessary for the fair determination of the case.
In a ruling delivered on Thursday, Milimani Principal Magistrate Geoffrey Onsaringo granted an application by the National Police Service to call six additional witnesses and also allowed IPOA to present two more witnesses, despite the oversight authority having already closed its case.
The court, however, declined an application to recall witness Doris Mukiri Mugambi for a third time, holding that allowing the request would amount to an abuse of the court process.
Magistrate Onsaringo ruled that the additional evidence sought by the parties was necessary to ensure the inquest is determined fairly and comprehensively.
The six additional witnesses include representatives from the Integrated Control and Communication Centre (IC3), Absa Bank, Makau Casino, Bliss Hospital and International Life House.
The court also permitted officers from Kamukunji, Kilimani, Pangani and KICC police stations to testify and produce Arms Movement Registers that may assist the court in establishing the circumstances surrounding Masai’s death.
In addition, IPOA was granted leave to call two further witnesses before the inquest is concluded.
To prevent further delays, the magistrate directed that no additional applications to recall witnesses would be entertained. He further ruled that no further witnesses would be allowed unless exceptional circumstances are demonstrated and the court is satisfied that the proposed evidence is necessary for the fair determination of the inquest.
The matter was scheduled for mention on August 6, 2026, when the court will fix hearing dates for the remaining witnesses.
