NAIROBI, Kenya — The High Court has directed the auction of Ecobank Kenya’s movable assets to recover Sh284 million owed to the estate of former Cabinet minister Mbiyu Koinange.
In an order issued on Friday, September 19, 2025, the court registrar instructed Moran Auctioneers to attach and sell the bank’s property after giving a 15-day notice and making a public proclamation.
The directive enforces a decree arising from Succession Cause No. 527 of 1981, a decades-old legal battle involving the late minister’s estate.
The auction follows a ruling delivered on June 26 by Justice Eric Kennedy Ogolla, who found Ecobank liable for unlawfully allowing withdrawals from an account belonging to the estate.
The account, held at Ecobank Towers in Nairobi under number 001005011762001, was depleted without proper authority, the court found.
Justice Ogolla ordered the lender to reimburse Sh284 million plus accrued interest from the date of deposit.
The estate had sued the bank in March 2024, demanding a full account of the missing funds and disclosure of those who benefited from the withdrawals.
The latest directive clears the way for auctioneers to move against the lender’s assets if the debt remains unpaid.
