ODPP Charges Former Homa Bay Officials in Sh348 Million Procurement Scandal

NAIROBI, Kenya — The Office of the Director of Public Prosecutions (ODPP) has formally directed charges against several former Homa Bay County officials and a private company over alleged procurement irregularities amounting to Sh348,927,840.

The case involves the award of a tender for the construction of the Homa Bay County Assembly office block.

In a statement dated January 16, 2026, the ODPP said investigations by the Ethics and Anti-Corruption Commission (EACC) revealed that the former Clerk of the County Assembly, Odhiambo Daniel Kaudo, along with five other senior county officials, allegedly engaged in irregular procurement practices.

The tender, issued under Tender No. HBCA/T/W6/2018–2019, was reportedly awarded to a company linked to county employees, raising concerns over conflict of interest, abuse of office, and violations of procurement laws.

The individuals and entities facing charges include:

  • Odhiambo Daniel Kaudo – Former County Assembly Clerk
  • Faith Adhiambo Apuko – Former Acting County Assembly Clerk
  • Patrick Tunoi – Senior Superintendent Quantity Surveyor, State Department of Public Works
  • James Mumali Oyuka – Director, Hartland Enterprises Limited
  • Mary Pauline Oduor – Principal Nurse, Homa Bay Referral Hospital and Director, Hartland Enterprises Limited
  • Roseline Anyango Odhiambo – Former County Executive Committee Member for Lands
  • Hartland Enterprises Limited

The charges outlined include:

  1. Abuse of Office, contrary to Section 46 and Section 48 of the Anti-Corruption and Economic Crimes Act.
  2. Willful Failure to Comply with Procurement Laws, contrary to Section 45(2)(b) of the Anti-Corruption and Economic Crimes Act.
  3. Conflict of Interest, contrary to Section 42(3) read with Section 48 of the Anti-Corruption and Economic Crimes Act.
  4. Unlawful Acquisition of Public Property, contrary to Section 45(1)(a) as read with Section 48 of the Act.
  5. Fraudulent Acquisition of Public Property, contrary to Section 45(1)(a) as read with Section 48 of the Act.

The ODPP reaffirmed its commitment to upholding the rule of law, promoting public interest, and preventing abuse of legal processes, highlighting that prosecutorial action aims to ensure accountability and proper administration of justice.

The case underscores ongoing efforts by Kenyan authorities to strengthen governance and enforce transparency in county procurement, particularly in large-scale projects funded by public resources.

“The ODPP remains unwavering in its constitutional mandate to investigate and prosecute corruption, safeguarding public resources and trust,” the statement concluded.
