NAIROBI, Kenya — The Office of the Director of Public Prosecutions has filed a notice of appeal challenging a High Court decision that cleared George Natembeya of corruption-related charges.
The ruling, delivered on March 4, 2026, by Justice Bahati Mwamuye, barred the ODPP, the Directorate of Criminal Investigations, and the Ethics and Anti-Corruption Commission from pursuing investigations or prosecution against the governor.
The court also awarded Natembeya Sh2.5 million in general damages.
The case relates to the alleged unlawful acquisition of public funds amounting to Sh3.25 million through transactions linked to companies doing business with the Trans Nzoia County Government.
Prosecutors allege that between January 2023 and April 2025, the governor received indirect financial benefits through entities including Lyma Agro Science Limited, Maira Stores, and Easterly Winds Limited.
The charges were brought under provisions of the Anti-Corruption and Economic Crimes Act, including conflict of interest offences.
