NAIROBI, Kenya — The Office of the Director of Public Prosecutions (ODPP) and Safaricom PLC have strengthened their collaboration to combat the theft and vandalism of telecommunications infrastructure, as authorities move to tackle emerging forms of organised crime.
The two institutions held a peer-learning workshop focused on improving the investigation and prosecution of cases involving damage and theft of telecom infrastructure.
The meeting brought together prosecutors and Safaricom representatives to share practical experiences, examine emerging criminal trends and identify ways to strengthen the criminal justice response.
Rising Telecom Infrastructure Crime
The workshop focused on increasing cases of vandalism and theft targeting Safaricom infrastructure and the wider impact on communication services.
Participants conducted a SWOT analysis of emerging threats affecting the telecommunications sector and discussed measures to improve the handling of related criminal cases.
The ODPP said damage and theft of telecom infrastructure can disrupt critical communication services and have wider economic and social consequences.
Prosecutors Seek Stronger Cases
Discussions centred on how investigators and prosecutors can make better use of the legal framework beyond the Penal Code when pursuing infrastructure-related crimes.
Participants examined how different laws could be applied to strengthen case preparation, secure appropriate convictions and help disrupt organised networks involved in the theft and vandalism of telecommunications equipment.
The workshop also sought to address practical and evidentiary challenges that can affect the prosecution of such cases.
POCAMLA, KICA Among Laws Reviewed
Participants examined the application of several laws, including the Proceeds of Crime and Anti-Money Laundering Act (POCAMLA), the Kenya Information and Communications Act (KICA), and the Computer Misuse and Cybercrimes Act.
The legislation can provide prosecutors and investigators with additional legal tools when dealing with cases involving stolen infrastructure, illicit proceeds and technology-related offences, depending on the facts and evidence in individual cases.
The discussions were aimed at improving understanding of how the different legal provisions can complement traditional criminal charges.
Intelligence Sharing Key to Investigations
Participants also emphasised the importance of timely information and intelligence sharing between investigators, prosecutors and private-sector stakeholders.
Improved evidence management and closer coordination were identified as key areas for strengthening cases involving telecom infrastructure.
The workshop further explored innovative prosecution strategies designed to respond to criminal networks that may adapt their methods as enforcement measures improve.
Public-Private Partnership
The ODPP said the engagement demonstrated the importance of public-private partnerships in protecting Kenya’s critical infrastructure.
Telecommunications companies play a central role in identifying infrastructure threats and providing information that can assist investigations, while law enforcement agencies and prosecutors are responsible for investigating and taking appropriate legal action based on available evidence.
Closer cooperation can therefore help bridge gaps between the identification of incidents and successful prosecution.
ODPP, Safaricom Commit to Continued Cooperation
The ODPP and Safaricom said sustained collaboration, intelligence sharing and coordinated prosecution strategies would remain important in tackling infrastructure-related crime.
The institutions said their efforts would focus on disrupting organised criminal networks, reducing repeat offending and protecting telecommunications infrastructure.
