Former Nairobi Provincial Commissioner Convicted In Sh1.35 Billion Land Fraud Case

Date:

NAIROBI, Kenya – Former Nairobi Provincial Commissioner Davis Nathan Chelogoi has been convicted in a land fraud case involving a 7.39-hectare property in Lower Kabete valued at Sh1.35 billion, following a prosecution by the Office of the Director of Public Prosecutions (ODPP).

The court found Chelogoi guilty of conspiracy to defraud land belonging to Ashok Rupshi Shah and Hitebkumar Amritlal Raja. The disputed property, registered as Nairobi/Block/80/44, is located along Lower Kabete Road.

Chelogoi was convicted on five counts, including conspiracy to defraud, forcible detainer, two counts of forgery and uttering a forged document.

Court Details Alleged Forgery Of Land Documents

The court found that Chelogoi forged a letter of allotment dated January 31, 1995, which purported to be a genuine document issued by the Commissioner of Lands.

The court also found that on October 11, 2023, at the Directorate of Criminal Investigations headquarters along Kiambu Road, Chelogoi knowingly presented forged documents, including the letter of allotment and a certificate bearing an allegedly forged signature and stamp impression of Paul Achieng Pesa.

The documents were purported to be a valid letter of allotment and land searches issued by the State Department for Lands and Physical Planning.

The prosecution team, comprising Sonia Njoki, Hillary Isiaho and James Murage, called 19 witnesses and presented documentary and expert evidence in support of the five counts against Chelogoi.

Court Cancels Bond Ahead Of Sentencing

Following the conviction, Chief Magistrate Dolphina Alego cancelled Chelogoi’s bond terms and ordered that he be remanded at Nairobi Remand Prison pending mitigation and sentencing.

The court scheduled sentencing for November 2, 2026.

It also ordered the land register to cancel any parallel title or registration issued over the disputed property, ruling that the land belonged to Shah and Raja.

The conviction follows the prosecution’s case that forged land documents were used in an attempt to claim the valuable Lower Kabete property.
