
NAIROBI, Kenya — A magistrate’s court has ordered the closure of a miscellaneous application involving social media influencer Halima Ngachia, popularly known as “Princess Halima,” as investigators continue probing allegations linked to an X account said to have published information about President William Ruto’s movements.
Ngachia appeared before the court on Monday after investigators sought more time to complete a forensic examination of electronic devices seized during her arrest.
After considering submissions from both the prosecution and the defence, the court directed that the miscellaneous application be closed.
Investigation continues
Investigating officers told the court that forensic analysis of the seized electronic gadgets was still underway and requested additional time to conclude the investigations.
The prosecution argued that closing the miscellaneous application could prejudice ongoing investigations.
Defence challenges seizure
The defence opposed the application, contending that investigators confiscated Ngachia’s electronic devices without obtaining a search warrant, contrary to the law.
Lawyers for the influencer also argued that issues concerning the legality of the custodial orders were already before the High Court, while the proceedings before the magistrate’s court related specifically to the seizure and retention of the electronic gadgets.
Following arguments from both sides, the court ordered the miscellaneous file closed.
No charges filed
Ngachia has not been charged with any criminal offence.
The closure of the miscellaneous application does not, by itself, terminate investigations. Police may continue investigations and, if warranted by the evidence, may make further applications or prefer charges in accordance with the law.
The case has attracted public attention amid growing debate over digital rights, due process, the powers of investigative agencies and the legal protections governing searches and seizures involving electronic devices.
