
NAIROBI, Kenya—The High Court has temporarily suspended the enforcement of an Independent Electoral and Boundaries Commission (IEBC) decision requiring Kipipiri MP Wanjiku Muhia to pay a Sh1.5 million fine, granting the legislator temporary relief as she challenges the ruling in court.
In interim orders issued by the High Court, the implementation of the IEBC judgment delivered on July 10, 2026, was stayed pending the hearing and determination of Muhia’s application contesting the electoral body’s decision.
The orders mean the commission cannot enforce the penalty until the court hears and determines the application.
“That in the meantime, pending the hearing and determination of the application, an order is hereby issued staying the judgment/determination of the 2nd Respondent issued on 10 July 2026,” the court order states.
The temporary stay effectively freezes the enforcement of the Sh1.5 million penalty until the court decides whether the IEBC’s decision should stand.
Muhia Challenges IEBC Decision
Muhia moved to the High Court seeking to block the implementation of the electoral body’s ruling, arguing that the decision should not be enforced before the court considers the merits of her application.
The legislator is seeking judicial intervention to challenge the IEBC determination, with the interim orders preserving the status quo until the matter is heard.
The High Court’s decision does not determine the merits of the dispute but temporarily halts enforcement of the commission’s ruling pending further directions.
The case is expected to proceed to hearing, where the court will determine whether to uphold or set aside the IEBC’s decision.
