MACHAKOS, Kenya — Machakos Governor Wavinya Ndeti has reinstated Finance County Executive Committee Member (CECM) Catherine Mutanu, complying with a High Court order that suspended her dismissal pending the hearing of a legal challenge.

In a statement issued on Monday, Governor Wavinya said Mutanu was free to immediately resume her duties, noting that the county government would abide by the court’s directive as the matter proceeds through the judicial process.

“As a law-abiding citizen, I respect the rule of law and will fully comply with the court order as the matter proceeds through the judicial process,” Wavinya said.

She added:

“I have therefore directed Hon. Catherine Mutanu to resume her duties as CECM for Finance with immediate effect, pending the hearing and determination of the case. I wish Hon. Catherine Mutanu all the best as she discharges her duties.”

Court Suspends Dismissal

The Governor’s decision follows a ruling by the Machakos High Court, which issued conservatory orders suspending the implementation of Mutanu’s dismissal.

Justice Josephine Mongare directed the respondents to file responses to Mutanu’s petition within seven days while preserving the status quo.

In the ruling, the court ordered:

“It is hereby ordered that in the interim, and pending the hearing and determination of this Application inter partes, this Honourable Court hereby does issue a conservatory order staying and/or suspending the implementation of the decision of the 1st Respondent contained in the letter dated July 6, 2026, vide which the 1st Respondent purported to dismiss the Petitioner/Applicant from her position as CECM for Finance, Economic Planning and Revenue Management.”

Dismissal Challenged in Court

Mutanu was dismissed from office just hours before she was scheduled to appear before the Machakos County Assembly to face an impeachment motion.

Following her removal, she moved to the High Court, filing a petition against Governor Wavinya and the Machakos County Government challenging the legality of her dismissal.

The court subsequently intervened, halting the implementation of the Governor’s decision pending the determination of the case.

Judge Warns Against Disobeying Orders

Justice Mongare also cautioned that failure to comply with the conservatory orders could attract legal consequences.

The judge warned that any individual, including the Governor, who disregards the court’s directives would be liable to penal sanctions.

The conservatory orders will remain in force until the case is heard and determined.

The matter is scheduled for mention before the Machakos High Court on July 23, when the court is expected to issue further directions.
