KIRINYAGA, Kenya- Detectives from the Directorate of Criminal Investigations (DCI) have arrested political blogger Justin Kinyua Mwangi over alleged hate speech and ethnic contempt, in a move that has reignited debate over freedom of expression and claims of selective enforcement against government critics ahead of the 2027 General Election.
According to a statement issued by the DCI, Mwangi was arrested on Tuesday in Wanguru Town, Mwea, Kirinyaga County, over social media posts investigators say amounted to hate speech and ethnic contempt.
Kinyua, who identifies himself on Facebook as a political storyteller and digital strategist and runs the Facebook account “Justin Kinyua,” is expected to be arraigned in court on Wednesday.
Police said he will face charges under Sections 13 and 62 of the National Cohesion and Integration Act, which criminalise hate speech and ethnic contempt.
In its statement, the DCI defended the arrest, saying while freedom of expression is guaranteed under the Constitution, it does not extend to content that incites hatred or threatens national cohesion.
“Freedom of expression is a constitutional right, but it is not a licence to sow division, incite hatred or threaten national stability. Those who abuse digital platforms to undermine peace and cohesion will face the full force of the law without exception,” the agency said.
Political Reactions
The arrest immediately attracted political attention, with Kirinyaga Woman Representative Njeri Maina identifying Mwangi as a blogger affiliated with the opposition-aligned Democracy for the Citizens Party (DCP).
“The era of political intimidations is here with us, but we shall not relent. We shall stand by the constitution and the young people of this great nation, whose right to free speech and political affiliation is protected by the constitution,” she said in a post on X.
Opposition figures and government critics argue that the arrest forms part of what they describe as an expanding crackdown on dissent and critics of President William Ruto’s administration.
They have accused security agencies of aggressively pursuing opposition activists, bloggers and online influencers while allegedly taking little or no action against pro-government politicians and social media personalities accused of making inflammatory remarks.
The allegations of selective enforcement come amid heightened political tensions as parties begin positioning themselves for the 2027 elections. Similar concerns have been raised in previous arrests involving activists and bloggers investigated over alleged incitement-related offences.
Growing Debate
Human rights groups and sections of the opposition have repeatedly argued that laws on hate speech, cybercrime and public order are increasingly being used to suppress criticism of the government, while authorities insist they are enforcing the law without regard to political affiliation.
The DCI has maintained that investigations are guided solely by evidence and that anyone found using digital platforms to promote ethnic hatred or violence will face prosecution regardless of political leaning.
Mwangi is expected to appear before court on Wednesday, where prosecutors are likely to formally present the hate speech and ethnic contempt charges against him.
