Judge Njoki Mwangi Recuses Herself from Diego Case Over Conflict of Interest

NAIROBI, Kenya- Justice Njoki Mwangi has disqualified herself from hearing the Diego case, citing a potential conflict of interest. 

The matter will now be placed before Justice Francis Gikonyo, Presiding Judge of the Commercial and Tax Division, for further directions.

The court had previously scheduled the matter for mention on February 18, 2026, after issuing directions in the case. 

However, a Notice of Motion filed on February 16, 2026, under a certificate of urgency by Njoroge Regeru & Company Advocates for the first defendant, prompted the need for reassignment. The law firm had also filed a Notice of Appointment on February 10, 2026.

In her ruling, Justice Mwangi explained that since Njoroge Regeru & Company Advocates represent her in a separate matter, it would be inappropriate to continue presiding over the Diego case, leading to her recusal.

This development comes just a week after Justice Freda Mugambi similarly disqualified herself from hearing another case involving the same parties, also citing a potential conflict of interest.

The February 16, 2026, application will now be placed before Justice Gikonyo for further directions on how the case will proceed.
