Joho’s ODM Retreat Appearance Sparks Debate Over CS Political Neutrality

MOMBASA, Kenya- Mining Cabinet Secretary Hassan Ali Joho has attended the Orange Democratic Movement (ODM) National Executive Council (NEC) retreat in Mombasa, a meeting aimed at strengthening the party’s internal structures and long-term political strategy.

In his remarks, Joho described the retreat as an important platform for party leadership to reflect on policy direction and organisational cohesion.

“It was a great honour joining fellow leaders this evening for the official commencement of the Orange Democratic Movement (ODM) National Executive Council retreat in Mombasa,” he said.

He added that the discussions would focus on strengthening ODM’s governance framework and enhancing service delivery.

“The retreat brings together the party’s leadership to deliberate on key policy, organizational, and strategic matters aimed at strengthening our collective vision and enhancing service delivery to the people,” Joho said.

He further noted that the engagements would help build unity and provide a clearer roadmap for the party’s development agenda.

“The discussions will provide a clear roadmap for advancing our development agenda and reinforcing unity within the party,” he added.

The retreat comes ahead of power-sharing negotiations between ODM and the ruling United Democratic Alliance (UDA).

Joho is eyeing on becoming President Ruto’s running mate among other top ODM officials.

Constitutional Questions Resurface

Joho’s participation has once again brought into focus the constitutional expectations placed on Cabinet Secretaries in Kenya.

Under Article 77 of the Constitution of Kenya (2010), State officers are expected to maintain political neutrality. The provision states that full-time State officers should not engage in other gainful employment or hold office in political parties, a framework designed to ensure impartiality in public service.

Cabinet Secretaries, as State officers under Article 260, are therefore expected to avoid active partisan political roles or formal participation in party decision-making structures.

Practice Versus Political Reality

Despite these constitutional provisions, the boundaries between governance and politics have often been blurred in practice.

Under the current Kenya Kwanza administration led by President William Ruto, critics have accused some Cabinet Secretaries of taking part in political mobilisation and party-aligned engagements linked to the ruling United Democratic Alliance (UDA).

Supporters of the administration argue that such participation is part of broader political consultation and development engagement rather than partisan campaigning.

Why Joho’s ODM Appearance Stands Out

Joho’s attendance at an ODM NEC retreat is politically significant because it places a serving Cabinet Secretary inside a party’s top strategic forum.

The NEC is responsible for high-level decision-making, including organisational direction and political strategy, raising questions about the extent to which State officers should engage in such party structures.

The development is likely to fuel renewed debate over the interpretation of Article 77 and whether Kenya’s political culture aligns with the strict neutrality envisioned in the Constitution.

While the Constitution calls for political neutrality among State officers, Kenya’s evolving political environment continues to test the practical boundaries between governance roles and party politics.
