NAIROBI, Kenya — The Judiciary has intensified preparations for Kenya’s 2027 General Election, with plans to train judicial officers, appoint and gazette special magistrates and prioritise election-related cases to strengthen the country’s electoral justice system.
Speaking during a High-Level Roundtable Consultative Meeting on Election Security, Vice Chairperson of the Judiciary Committee on Elections (JCE), Justice Daniel Musinga, said the Judiciary had already begun implementing a comprehensive preparedness programme ahead of the 2027 electoral cycle.
Musinga said the programme would equip judges, judicial officers and Judiciary staff involved in electoral justice with the skills required to handle election-related disputes and offences.
“The Judiciary has already embarked on a comprehensive programme of preparedness for the 2027 electoral cycle through the Judiciary Committee on Elections (JCE). An important part of this work is the training and continuous capacity-building of judges, judicial officers and judiciary staff who will be involved in electoral justice,” he said.
The training and continuous capacity-building programme is expected to focus particularly on judicial officers who will handle electoral disputes and offences during the election period.
Special magistrates planned for election offences
The Judiciary is also working towards the appointment and gazettement of Special Magistrates to handle election-related matters.
According to a statement posted by the Judiciary on X on Thursday, September 3, 2026, the JCE is liaising with the Office of the Chief Justice on the “appointment and gazettement of Special Magistrates as contemplated under section 23 of the Election Offences Act.”
The proposed appointments are intended to increase the Judiciary’s capacity to handle election offences and related proceedings as political activity intensifies ahead of the 2027 polls.
Specialised judicial capacity is particularly important during elections, when courts can be called upon to deal with a wide range of disputes, including election offences and other cases arising from political campaigns and voting.
Election cases to receive priority
The Judiciary has also reaffirmed its commitment to giving election-related cases priority during the electoral period.
Musinga said the commitment would cover both electoral disputes and criminal cases arising from the election process.
“The Judiciary is committed to prioritising election-related cases, including cases that are criminal in nature,” he said.
He stressed that timely determination of cases was important for ensuring substantive justice and maintaining national stability.
The Judiciary will also strengthen its case-management arrangements during the electoral period while continuing to operate within the constitutional and legal framework governing judicial discipline and accountability.
Courts’ role in protecting electoral justice
The Judiciary plays a critical role in resolving disputes that arise during elections and in determining cases involving alleged breaches of electoral laws.
The preparedness programme comes as Kenya’s political environment is expected to become increasingly active ahead of the August 10, 2027, General Election.
Timely resolution of electoral disputes can help reduce uncertainty and prevent prolonged legal battles from undermining confidence in electoral institutions.
At the same time, criminal cases arising from election-related offences require courts to maintain due process and ensure that accused persons receive a fair hearing.
