MOYALE, Kenya — Two men have been sentenced to death after being convicted of four counts of robbery with violence over an April 2025 attack in Dabel, Moyale Sub-County, in which four people were robbed and injured.
Nashon Ochieng Agutu and Jackson Okech Odhiambo were found guilty on all four counts following a full trial at the Moyale Law Courts.
Senior Principal Magistrate Willy Cheruiyot delivered the verdict after the prosecution presented evidence linking the two men to the attack.
Four victims robbed and injured
According to the Office of the Director of Public Prosecutions (ODPP), the incident occurred on April 23, 2025, in the Dabel area of Moyale Sub-County, Marsabit County.
The prosecution said Agutu and Odhiambo acted jointly with others and were armed with dangerous weapons, including guns, when they attacked Alinoor Mamo, Silas Kalunge, Linus Murithi Marinda and Bruno Thomas.
The four victims were robbed of cash, mobile phones and other personal belongings during the attack.
The ODPP said the victims were also assaulted and sustained injuries.
Prosecution calls 13 witnesses
The two men were charged with four counts of robbery with violence, contrary to Section 295 as read with Section 296(2) of the Penal Code.
Prosecution Counsel Benard Leadi called 13 witnesses to support the case against the accused.
The evidence presented during the trial led the court to convict both men on all four counts.
Court cites brutality and use of guns
While passing sentence, Magistrate Cheruiyot considered the circumstances surrounding the robbery, including the injuries suffered by the victims and the alleged use of lethal weapons.
“The court has taken into account the nature of the robbery attack, its brutality and the use of lethal weapons. A deterrent sentence is warranted. I sentence the two to death,” the magistrate ruled.
The death sentence followed their conviction for robbery with violence.
14 days to appeal
Agutu and Odhiambo were granted 14 days within which to appeal against both their conviction and sentence.
The case arose from the April 2025 attack in Dabel, where the four victims were reportedly targeted in a robbery involving several attackers.
The conviction and sentence remain subject to the accused persons’ right of appeal.
