Kitui MCA Cyrus Musyoka to Face Court Over Sh4.9 Million Phone Theft Allegations

Date:

NAIROBI, Kenya – Kitui County Assembly Member Cyrus Kisavi Musyoka is expected to appear before the Milimani Law Courts on Tuesday, November 3, after spending several days in police custody over allegations involving mobile phones valued at Sh4.9 million.

Musyoka, who represents Ikanga/Kyatune Ward and is popularly known as Sonko, is being investigated over claims that he stole phones worth approximately Sh4,906,050 by targeting consignments being transported through courier services.

According to a detention application filed by the Directorate of Criminal Investigations (DCI), the legislator allegedly stole phones from courier operators’ premises or manipulated delivery instructions to redirect consignments to different destinations.

“The total value of the stolen phones stands at Ksh4,906,050 at the moment,” investigators stated in the court documents.

The DCI had sought permission to detain Musyoka for 15 days at Kamukunji Police Station to complete investigations. However, Principal Magistrate Paul Mutai granted investigators seven days, setting the stage for his anticipated court appearance on Tuesday.

DCI Raises Concerns Over Previous Court Cases

Investigators also cited Musyoka’s previous encounters with the criminal justice system in opposing his release during the ongoing investigations.

According to the application, he had previously been charged with stealing at Makadara Law Courts in 2024 under case number E5813 of 2024.

The DCI alleged that he failed to attend court, resulting in the withdrawal of the matter, which was subsequently reinstated in 2025 under case number E2893 of 2025.

Investigators further claimed that he again absconded before being arrested in connection with the latest allegations.

The DCI said Musyoka was arrested on October 22, 2026, although its public statement published on October 23 confirmed that detectives had apprehended him in Nairobi’s Mfangano Street over three reported phone theft incidents recorded in August and September.

The agency said CCTV footage played a significant role in identifying him during investigations.

State Says MCA Could Abscond Again

In seeking continued detention, the State argued that Musyoka presented a flight risk, pointing to what investigators described as his previous failures to attend court.

The prosecution also told the court that detectives needed additional time to establish his identity, saying questions had been raised about whether he was indeed the sitting Kitui MCA.

The identity issue was included among the grounds advanced by investigators in support of their application for custodial orders.

Musyoka is being investigated for stealing contrary to Section 268(1), as read with Section 275 of the Penal Code.

His anticipated appearance at Milimani Law Courts on November 3 is expected to provide an opportunity for the next stage of proceedings, including the formal presentation of any charges arising from the investigation.
