‘They Left Me With Nothing’: Prof Ndetei’s Explosive Claims Against His Children in Court

Date:

NAIROBI, Kenya – Professor David Musyimi Ndetei has accused his son, Chris Mulwa, and daughter, Angela Mulwa, of coordinating his eviction from the family’s Mlolongo home, telling the High Court that he was left with nothing after the property was allegedly raided and looted.

Testifying before Justice Alexander Muteti at the Milimani High Court on Wednesday, October 21, Ndetei recounted the March 2026 eviction as he opposed the release on bail of his estranged wife, Rose Mbithe Mulwa, and their two children, who are among those charged in connection with the murder of his late wife, Dr Victoria Nthunya Mutiso.

Ndetei alleged that his children played a role in coordinating the operation that forced him out of the property, which he described as a Sh1.5 billion matrimonial home.

“They sent me away with nothing; they took everything from my house. That young boy was coordinating, and that girl, my daughter, was coordinating the looting of my house, and they made sure I went away,” he told the court.

The allegations emerged during cross-examination of an affidavit Ndetei had sworn opposing bail for the three accused persons.

Professor Says He Fears for His Life

Ndetei urged the court not to release the accused persons, claiming their freedom would put his life at risk.

“I am opposed to them being released on bail and bond because if they are released on bail, they will try to kill me, as they tried to kill me before,” he testified.

He also maintained that he had not met his son during the March eviction, describing the people involved as thugs who attacked him and his family.

“Those were thugs; they were thugs coming to evict me. They attacked me,” he said.

The court has yet to determine the bail application. The accusations against the three suspects remain allegations and have not been established as findings of guilt.

Defence Questions History of Family Dispute

During the proceedings, the defence questioned Ndetei about his relationship with his former wife and children, including whether he knew that his former wife had previously reported him over alleged violence and obtained a P3 medical examination form.

Ndetei acknowledged awareness of the report but denied being violent or ever beating her. He described her as a “pathological liar”.

He also told the court that his last contact with his former wife and children was on September 19, 1996, when he said he was away from home. The family later divorced in 2001, according to previous court reporting.

The disputed property and the breakdown of the family relationship have featured prominently in proceedings surrounding the murder case.

Bail Hearing Reopened Over Affidavit

Ndetei appeared in court after Justice Muteti allowed the defence to reopen the pre-bail proceedings to cross-examine him over an affidavit opposing the release of his former wife and their children.

The defence had questioned the affidavit’s authenticity, alleging that it may not have been properly sworn and disputing the circumstances in which it was prepared. The judge ordered cross-examination to establish whether Ndetei personally swore the document and whether its contents were truthful.

The court had rejected the defence’s separate claim that Ndetei lacked the mental capacity to swear the affidavit, saying no evidence had been presented to support that allegation.

The three accused persons are among seven suspects charged in connection with the killing of Dr Mutiso, who was shot dead in Nairobi in July 2026.

The bail proceedings are expected to help the court assess whether the accused persons should be released while the murder case continues.

Ndetei’s testimony has brought the long-running family and property dispute into sharper focus as the court considers competing claims over the contested affidavit and the risks associated with bail.
