NAIROBI, Kenya- DCP Party leader Rigathi Gachagua has withdrawn two petitions challenging his impeachment.
The former Deputy President through his lead counsel, Paul Mwite, asserted that the petitions have since been overtaken by events, considering the prevailing circumstances.
“The impugned bench proceeded to vacate the conservatory orders in a ruling which allowed one Prof Kithure Kindiki to be sworn in as Deputy President,” said Mwite.
“Our stay application is thus overtaken by events, very regrettably.”
Gachagua had in October last year filed an appeal at the Court of Appeal challenging Deputy Chief Justice Philomena Mwilu’s powers to empanel a bench to hear his ouster petition.
This would however not hold water after the three judge bench declined to extend conservatory orders that would have ostensibly delayed the swearing in of Kithure Kindiki as Deputy President.
Kindiki was, however, sworn in to succeed Gachagua as the country’s second in command.
Albeit Gachagua’s withdrawal of the two consolidated cases, the DCP party leader has still taken issue with Mwilu’s capacity to empanel a three-judge bench to hear his petition.
According to his legal team, the matter will still be pursued, in what they argue is a preserve of Chief Justice Martha Koome.
The dramatic turn of events comes hot on the heels of the former Mathira lawmaker launching his party in an event marred by violence yesterday.
Gachagua has been on a charm offensive to woo his vote-rich Mount Kenya backyard to back his political leadership, even as he races against time to lock out the ruling United Democratic Alliance (UDA) out of the region.
Earlier, Gachagua disclosed that he intends to form a coalition with an array of parties, including the breakaway faction of Azimio led by Kalonzo Musyoka, Martha Karua, and Eugene Wamalwa, as the 2027 state house race gathers momentum.
