MOMBASA, Kenya- A woman has been charged in a Mombasa court over an alleged land fraud involving two parcels in Likoni valued at Sh100 million.
Farzana Nur Butt appeared before Senior Resident Magistrate Gladys Olimo, where she denied three charges relating to land registered in the name of Susan Wanjiru Kangethe.
The first charge is conspiracy to defraud, contrary to Section 317 of the Penal Code.
The prosecution alleges Butt conspired with other people who were not before the court to claim Kangethe’s parcels, identified as Mombasa/MS/Block 1/1944 and Mombasa/MS/Block 1/1945.
The alleged conspiracy is said to have taken place between July 12, 2006, and October 20, 2026, in the Coast region.
The prosecution told the court the two parcels are registered at the Mombasa Land Registry and were allegedly claimed without the authority of their registered owner.
The court heard that Butt allegedly caused the same land to be registered in the names of her relatives, Jamshed Ahmed Butt and Fahmeda Begum Butt.
Prosecutors said she knew the information used to claim the parcels was false.
The second charge is obtaining registration of land by false pretences, contrary to Section 320 of the Penal Code.
The charge alleges that on July 12, 2006, Butt inserted Title Lease No. Mombasa/MS/Block 1/416 into the land records at the Mombasa Land Registry.
The prosecution alleges that the lease was inserted with the intention of depriving Kangethe of the two parcels in Shelly Beach, Likoni.
It also alleges that Butt knew the information recorded in relation to the lease was false.
The third charge is forcible entry, contrary to Section 90 of the Penal Code. Prosecutors allege that Butt entered the premises at Shelly Beach without the registered owner’s authority.
The alleged forcible entry is said to have occurred on different dates between July 9, 2025, and October 20, 2026.
The prosecution told the court the entry was intended to annoy the registered owner.
Butt pleaded not guilty to all three charges.
Through her lawyer, she asked the court to release her on reasonable bond terms, saying she had a fixed residence within the court’s jurisdiction.
Assistant Director of Public Prosecutions Breda Ogada urged the court to set bond terms appropriate to the charges.
Magistrate Olimo ordered Butt released on a bond of Sh1 million with a surety of a similar amount.
The court scheduled the case for a pre-trial conference on November 12, 2026.
