Court Sentences Waititu to 13 Years Over Sh588 Million Kiambu Tender

Date:

NAIROBI, Kenya—Former Kiambu Governor Ferdinand Waititu has been handed an additional 13-year prison sentence in the Sh588.7 million corruption and money-laundering case involving a controversial county roads tender.

Milimani Anti-Corruption Chief Magistrate Harrison Barasa on Monday, November 2, sentenced Waititu to five years on Count 10, four years on Count 11 and another four years on Count 12.

The court also imposed fines totalling Sh21 million, with alternative prison terms in default of payment.

However, Waititu will not serve the 13 years on top of his existing sentence. The court directed that the new prison terms run concurrently with the 12-year sentence imposed in February 2025 in a separate corruption-related sentencing decision.

This means the latest sentences will run alongside his existing term rather than extend it by another 13 years.

“On count 10, Ferdinand Waititu is fined Sh10 million, in default, imprisonment of five years,” Barasa ruled.

The magistrate said the sentences would follow directions previously issued by the High Court in its October 14, 2026 ruling.

Waititu’s wife fined Sh22 million

Waititu’s wife, Susan Wangari, was also sentenced on the three money-laundering counts.

The court fined her Sh12 million on Count 10. On Count 11, she was sentenced to two years in prison or a fine of Sh2 million.

She was further fined Sh8 million on Count 12, bringing her total fines to Sh22 million.

The penalties followed the High Court’s October 14 decision, which overturned the couple’s earlier acquittals on money-laundering charges and upheld convictions arising from the Kiambu roads tender case.

Case involves Sh588.7 million Kiambu roads tender

The case concerns a Sh588.7 million contract awarded to Testimony Enterprises Limited for road upgrades in Kiambu County during the 2017/2018 financial year, when Waititu was governor.

The prosecution linked the accused persons to alleged procurement irregularities and the handling of funds connected to the contract.

Before the November 2 sentencing, state prosecutor Vincent Monda had urged the court to impose six years in prison on each count against Waititu and Wangari.

The defence had challenged aspects of the sentencing process, including whether the accused should be sentenced as individuals or in their corporate capacity.

On October 14, High Court Judge Rose Ougo overturned the trial court’s acquittals on money-laundering charges while upholding convictions on other corruption-related offences.

The decision returned the matter to the magistrate’s court for mitigation and sentencing. The High Court also revoked the accused persons’ bail and bond terms, resulting in their return to custody.

Waititu had previously been sentenced to 12 years in prison, with an option of paying a fine, following his conviction in February 2025.

The latest ruling therefore determines the penalties arising from the money-laundering counts while directing that the prison terms run concurrently with the existing sentence.
