High Court Refers JKIA Leasing Case to Chief Justice to Constitute a Bench

NAIROBI, Kenya – In a development regarding the contentious leasing of Jomo Kenyatta International Airport (JKIA) to the Adani Group, the High Court has referred the case to Chief Justice Martha Koome.

Justice John Chigiti emphasized the gravity of the issues raised, stating that they warrant the attention of a multi-judge bench.

The referral comes in response to a lawsuit filed by the Kenya Human Rights Commission (KHRC) and the Law Society of Kenya (LSK), who argue that leasing a vital and profitable asset like JKIA to a private entity raises serious concerns about governance and accountability.

They contend that such a move violates principles of transparency and prudent use of public funds, labeling it as inherently irrational.

Upon the initial filing, Justice Chigiti issued a temporary order preventing any implementation of the Adani proposal for JKIA until the court reaches a decision.

This order underscores the case’s importance, given the airport’s strategic role in Kenya’s economy and international connectivity.
