NAIROBI, Kenya — The Milimani High Court has certified as urgent a legal challenge against the liquidation of the Kenya Union of Savings and Credit Cooperatives (KUSCCO), setting the stage for a court hearing that could affect the winding-up process and the interests of members with funds tied to the organisation.
According to court documents obtained by ynews.digital, the application was filed under a certificate of urgency and will be heard during the court recess following directions issued on Friday, September 4.
“Upon considering the merits of the said application, it is hereby ordered that the application be certified as urgent and shall be heard during the recess period,” the court documents stated.
The court directed that the application be served on the relevant parties, including the appointed liquidators and any other persons who may be affected by the orders being sought.
Those served have been given an opportunity to respond before the matter returns to court on Tuesday, September 8.
Challenge comes after KUSCCO liquidation
The court case follows the government’s decision to cancel KUSCCO’s registration and place the co-operative union under liquidation.
The move was announced through a Gazette Notice published on August 31, which cited liquidity challenges affecting the organisation’s operations.
The government subsequently appointed three officials from the State Department for Co-operatives to oversee the winding-up process for a period of up to one year.
The liquidators are expected to assume custody and control of KUSCCO’s property, financial records and other documents required to facilitate the liquidation process.
The court challenge now introduces a legal contest over the government’s decision at a time when the liquidation process is already under way.
Liquidators tasked with winding up KUSCCO
Under the liquidation arrangement, the appointed officials are expected to undertake the responsibilities necessary to wind up the organisation.
This includes securing KUSCCO’s assets and records and managing matters arising from the organisation’s financial and operational position.
The process is likely to attract close attention from SACCOs and other stakeholders with financial or institutional interests in KUSCCO.
The urgent application could determine whether aspects of the liquidation proceed as planned or whether the court issues orders affecting the process while the dispute is considered.

Government had proposed restructuring KUSCCO
The liquidation comes after months of discussions over how to reform KUSCCO following years of financial and governance challenges.
In July, the government announced plans to convert the organisation into a federation as part of broader reforms targeting the co-operative sector.
Under the proposed model, KUSCCO would have moved away from providing financial services and instead concentrated on governance, oversight and support for SACCOs.
The restructuring plan was intended to redefine the organisation’s role and address concerns surrounding its financial operations and governance.
