NAIROBI, Kenya- Githunguri Member of Parliament Gathoni Wamuchomba has questioned what she termed selective application of justice following the arrest and prosecution of her colleague, Mukurweini MP John Kaguchia, over remarks linked to political tensions ahead of the 2027 General Election.
Wamuchomba, a supporter of President William Ruto’s administration, said Kaguchia’s arrest and prosecution followed due process but raised concerns over whether similar action would be taken against other individuals accused of making inflammatory remarks.
“The arrest and prosecution of Hon Kaguchia over his flawed statement was procedural and in line with the Constitution,” Wamuchomba said.
“However, of great concern is the selective application of justice to those others who have been inciting and threatening others in the name of 2027 politics.”
She added: “If we are arresting, we need to hear the next one today. The public confidence is getting eroded daily. Who is next?”
Kaguchia was arrested and charged over remarks that authorities said amounted to hate speech and ethnic contempt.
The DCI has previously stated that freedom of expression is protected under the Constitution but does not extend to statements that promote hatred, incitement or threaten national cohesion.
The National Cohesion and Integration Act criminalises ethnic contempt and hate speech, with enforcement agencies maintaining that individuals who violate the law will face legal action regardless of their political affiliation.
The Githunguri MP has previously been vocal on governance issues while supporting President Ruto’s administration.
The Police have been accused of turning a blind eye on government allied politicians accused of spewing ethnic hatred like Health CS Aden Duale.
Bloggers associated with the opposition have also not been spared in what has been described as a crackdown on the voice dissent.
