NAIROBI, Kenya- Deputy President Kithure Kindiki has moved to court seeking permission to cross-examine renowned cardiologist Dr Dan Gikonyo over an affidavit filed in the ongoing impeachment-related legal battle involving former Deputy President Rigathi Gachagua.
According to court filings and media reports, Kindiki is also seeking leave to challenge the medical report presented by Dr Gikonyo, which outlines Gachagua’s health condition during the period surrounding his impeachment proceedings.
The Deputy President argues that the affidavit raises contested medical and procedural issues that require clarification through oral testimony, particularly regarding the timing and preparation of the report.
Legal documents show that Kindiki’s legal team is questioning when and how the medical report was prepared, suggesting that its contents have significant implications for the validity of claims made in the impeachment-related proceedings.
The affidavit by Dr Gikonyo, a senior cardiologist at Karen Hospital, has already been admitted into evidence by the High Court following a ruling that allowed it to remain on record in the interest of justice.
However, the court has also indicated that respondents may be granted permission to cross-examine the doctor if they formally request it, with Dr Gikonyo expected to appear in court should cross-examination be allowed.
The dispute is part of broader constitutional petitions challenging aspects of Gachagua’s impeachment, with arguments ranging from procedural fairness to the admissibility of medical evidence.
The court is expected to issue further directions on whether Dr Gikonyo will be required to testify and be cross-examined in person in upcoming hearings.
