EFF Condemns Malema Sentencing, Vows Appeal in Firearm Case

JOHANNESBURG, South Africa — The Economic Freedom Fighters (EFF) has condemned the sentencing of its leader, Julius Malema, describing the outcome as politically motivated and disproportionate.

In a strongly worded statement issued Thursday, the party said the case—arising from a 2018 firearm discharge incident at an EFF anniversary rally in Mdantsane—had been pursued in a “highly politicised environment” aimed at criminalising Malema’s political voice.

“The EFF reiterates that this case has always been pursued… with clear intentions to criminalize a revolutionary political voice,” the party said.

The statement criticised the imposition of a custodial sentence, arguing it was inconsistent with the facts of the case, particularly given that no injuries were reported.

The party also took aim at the National Prosecuting Authority (NPA), accusing it of pursuing imprisonment aggressively in contrast to its handling of other serious crimes.

“This is the same prosecuting authority that routinely fails to secure convictions in cases of violent crime… yet mobilised its full capacity to ensure that President Malema is incarcerated,” the EFF said.

During sentencing, Malema’s defence team, led by advocate Tembeka Ngcukaitobi, argued that there was no intent to cause harm, describing the firearm discharge as symbolic and occurring in a celebratory political context.

The defence further highlighted the absence of injury or demonstrable harm and presented mitigating factors, including Malema’s personal circumstances and public role, urging the court to adopt a proportionate sentence.

They also raised concerns about alleged procedural irregularities, including claims that a co-accused had a firearm returned before judgment—an issue the defence argued undermined the integrity of the prosecution’s case.

The EFF said these arguments were not sufficiently considered, reinforcing its position that the prosecution was driven by ulterior motives rather than a neutral application of the law.

The party linked the case to broader political dynamics, alleging sustained legal and political pressure against Malema by lobby groups such as AfriForum, which it accused of targeting the EFF leader for his positions on land reform and economic policy.

It also referenced international commentary, including remarks by Donald Trump, as part of what it described as a wider alignment of forces opposed to its political agenda.

Drawing historical parallels, the EFF cited figures such as Patrice Lumumba, Thomas Sankara, and Steve Biko, arguing that leaders advocating for radical change have often faced repression.

“President Malema’s sentencing must therefore be understood… as part of a broader effort… to discipline and silence those who refuse to abandon the struggle,” the party said.

The EFF confirmed that Malema will appeal the sentence, calling on its supporters to remain calm while legal processes unfold.
