Kerugoya Court Extends Orders Halting Mwea Rice Mills Privatisation

KIRINYAGA, Kenya — The Kerugoya High Court has once again extended conservatory orders suspending the planned privatisation of Mwea Rice Mills (MRM), granting more time for two farmers who have challenged the move to be heard.

Justice Edward Muriithi extended the orders after the Attorney General, who had been directed to appear following physical service by the petitioners, failed to attend the court session for a second time.

The judge noted the absence of representation from the AG’s office and confirmed that the matter will now proceed to hearing and determination on December 3, 2025.

“There was no one from the Attorney General, so there is need to be informed hearing has been set for 3rd December 2025… the cost will await the outcome of the petition,” Justice Muriithi ruled.

The case was filed by Mwea rice farmers Pius Njogu and John Munene, who moved to court shortly after President William Ruto assented to nine key bills on October 15, 2025.

Among them was the Privatisation Act 2025, a law that proposes the privatisation of several state-linked entities, including Mwea Rice Mills.

The farmers argue that the proposed privatisation threatens their livelihoods and risks placing control of the vital rice-processing facility in the hands of private interests without adequate safeguards for growers.

Their petition also names the Mwea Rice Growers Cooperative Society Ltd (MRGM) and MRM as respondents.

Until the case is heard next month, the conservatory orders remain in force, temporarily halting any privatisation steps involving MRM.
